Bank tabhi SARFAESI Act lagu kar sakta hai jab:

  1. Loan 90 din tak unpaid rahe (i.e. 3 EMI default ho) RBI ki guidline ke anusar.
  2. Loan amount ₹1 lakh se zyada ho
  3. Total outstanding secured loan 20% se kam na ho.

Important Exceptions:

  • Agar due amount ₹1 lakh se kam hai → SARFAESI Act lagu nahi hota
  • Agar borrower ne principal amount ka 80% repayment kar diya ho → Act lagu nahi hota
  • Agar unsecured loan default hua ho, aur secured loan regular ho → Secured loan pe act lagu nahi hota
